New York Driver Responsibility Program

Driver Responsibility ProgramIf a driver is convicted of certain traffic violations in New York or accumulate 6 or more points within an 18 month period, the driver must pay a fee over a 3 year period. This is an addition to any other penalties or surcharges that the driver must pay for committing the traffic violation. The purpose of the Driver Responsibility Program is to prevent repeated behaviors from problem, high-risk, drivers and to improve the safety in traffic.

Drivers must pay into the Driver Responsibility Program if they:

  • Have committed an alcohol or drugged driving-related traffic violation while driving a motor vehicle, snowmobile, or boat within New York State.
  • Are found to have refused to take a chemical test for blood alcohol content within New York State.
  • Received 6 or more points on their New York State driver’s record within an 18 month period for convictions of traffic violations within New York, Quebec or Ontario.

Drivers are responsible to pay into the Driver Responsibility Program if they have a driver’s license issues by New York, another jurisdiction or if they do not have a driver’s license.

The amount that needs to be paid depends on the type of violation that is committed or the total number of points that has accrued on the driver’s record. If the driver does not pay into the Driver Responsibility Program, the driver’s license will be suspended.

  • If the driver is convicted of an alcohol or drug-related offense or even refuses to take the chemical test, the driver must pay an annual fine of $250 into the program for the term of 3 years, totaling $750.
  • If the driver receives 6 points on their driving record for committed violations within an 18 month period, the annual fine is $100 for the term of 3 years, totaling $300. For every point after the 6 initial points, an additional $25 is added to the annual fine.
